Description
Eventide has guidelines for all employees regarding Privacy.
Purpose
Eventide Homes (NSW) Limited ABN 49 000 388 385 (the company) is committed to protecting the privacy of its residents, employees, volunteers, suppliers and other stakeholders in the provision of care and services. As part of this commitment, this Privacy Policy outlines how the company manages the personal information it collects and maintains about residents, employees, volunteers, suppliers and other stakeholders.
Scope
The following guidelines shall be adhered to by all managers, supervisors and employees.
Collection of personal information
When collecting personal information, the company will, wherever possible, indicate the purpose for the collection and use of the information to whom it may be disclosed and how one can request access to the information.
The company only collects information that it needs in order to operate as a retirement village provider. To effectively and efficiently provide care and services, it needs to collect certain personal information to ensure the health and safety of individuals residing in the facility and to assist in determining what type of care and services it should be providing them. We may therefore request information about:
The company will endeavour to collect all information from you directly, however from time to time, we may also collect information from other sources, such as from your family or nominated person(s) responsible and health care professionals involved in your health care or from previous employers about your work history and performance. If you choose not to provide us with information we request, we may not be able to provide you with the services you require or provide you with employment.
Use of personal information
The company uses the personal information it collects for the purpose of providing services and for the effective operations of its business. This includes, but is not limited to, using information to:
Provide appropriate services;
Enable contact and lawfully liaise with substitute decision makers regarding a resident’s status;
Provide data to government agencies as described in state and federal law;
Provide information in order to receive appropriate entitlements from state and federal agencies;
Undertake employee selection, recruitment and management activities;
Undertake quality assurance and stakeholder satisfaction activities;
Practice effective risk management; and
Resolve concerns.
Disclosure of Personal Information
The company will only disclose information in order to provide and manage the services it provides to residents and to operate an efficient and sustainable business. As such, the company may disclose information to third parties including, but not limited to:
Health professionals and health services that may be involved in managing or treating you; Any person acting on our behalf, including professional advisers and consultants;
Service providers and suppliers engaged by us;
State and federal government and regulatory bodies;
Any authority, agency or individual, where disclosure is permitted or required by law.
Where the company engages contractors, service providers or others to act on our behalf, we will take reasonable steps to protect the privacy of all information disclosed and require such parties to comply with any relevant privacy laws. You have the right to ask these organisations or contractors for access to information they hold about you. If we send your personal information outside of Australia, we will require that the recipient of the information complies with privacy laws and contractual obligations to maintain the security of the data.
Data Quality
The company will take reasonable steps to ensure that personal information it collects, uses and discloses is accurate and current. If you believe any information that we hold about you is incorrect, incomplete or out-of-date, please contact us. We will respond to your request within a reasonable period and will take reasonable steps to amend your records.
Protection and security of personal information
The company holds personal information in a combination of secure electronic and hard copy formats. We will take all reasonable steps to ensure that any personal information held by us is protected from misuse, loss and unauthorized modification or disclosure. Such steps include secure physical storage of documents, office premises security measures, network and communications security measures and quality systems procedures.
The company will keep information for as long as it is required to be able to provide the intended services or to meet legal and regulatory requirements. We will take reasonable steps to permanently de-identify or securely destroy personal information that we no longer require for any purpose except in limited permitted circumstances.
Accessing and updating your personal information
You (or your authorized representative) are generally entitled to access the personal information we hold about you except where access can or must be denied or limited by the Privacy Act 1988 (Cth).
To request access to your personal information, please contact the company’s Village Manager. Requests for information should include:
If the person requesting information is an authorized representative, proof that the person requesting access is lawfully authorized to do so (such as a copy of the Enduring Power of Attorney appointing the person as well as a copy of the person’s driving licence or passport);
Specific details of the information sought so that we can identify what personal information is being requested;
The form in which the information is requested (for example, a copy of the information or a request to view the information contained in our records).
We will not charge a fee for lodging a request for access or for compiling information in response to your request.
We will generally provide access to personal information in the form requested unless this is unreasonable or impractical, in which case we may provide the information in another way. For example, if providing information may have an unreasonable impact on the privacy of other individuals, we may provide only some of the information. If you believe the personal information we hold is inaccurate, incomplete, not up to date or misleading, you may request that the information be amended and we will take reasonable steps to correct the information.
If we decide not to grant access to personal information or we refuse to correct personal information, we will provide you with written reasons for our decision, the mechanisms available for you to make a complaint and any other matters that we may be legally required to tell you.
On line data use and protection
People can generally visit our website without revealing who they are or providing any personal information. The company will not collect any personal information about visitors to our website, except when visitors take steps to provide personal information to us, for example when submitting an enquiry. Information provided through our website will be collected, held, used and disclosed in accordance with this Privacy Policy.
The internet is not always a secure method of transmitting information. Whilst the company takes reasonable steps to ensure that the information that it receives is maintained securely, it cannot ensure that communication conducted via the internet will be secure.
Notifiable Data Breach
If the company determines that personal information has been accessed without permission, acquired, used or disclosed in a manner which comprises the security the personal information, we will assess the risk to affected parties.
If the company determines that a breach causes serious harm to an individual, we will notify all affected parties including the individuals to whom the data pertains and the Australian Information Commissioner and Privacy Commissioner. The notification will provide recommendations about the steps individuals should take in response to the breach.
Anonymity
You can choose to deal with us anonymously or use a pseudonym (in so far as this does not contravene any legal requirements), however we may not be able to provide you with the best service or effectively deal with any issues raised, without all of your personal information.
Prospective Employees, Volunteers and Contractors
The company may collect personal information when canvassing recruitment of staff or volunteers. We will collect personal information that you supply to us as part of the recruiting process for the purpose of assessing your application. We will collect information about you from third parties such as referees, as part of your assessment of your suitability for a position. In providing contact details for your referees, you are considered to have given your consent to our collecting personal information from your referees that may assist us in assessing your application. Similarly, we may confirm details about your past positions with previous employers. We may also collect health information directly related to your ability to perform inherent requirements of the position, with your consent.
If we are considering offering you a position, we may collect additional personal information about you such as your date of birth, tax file number, emergency contact details, bank account and superannuation information, licence details, ABN (if relevant) and details relating to your police check.
We may retain your details on file to enable us to contact you if you have been previously unsuccessful and an appropriate position becomes available.
Healthcare Professionals
The company may collect personal information about individual healthcare professionals who interact with us and who are involved in the care of our residents. This information is typically information such as their name, contact details, professional details and information regarding interactions and transactions with the company.
Other Individuals
The company may collect personal information about individuals who we deal with on a commercial basis such as suppliers, contractors and individuals in organisations from which we acquire goods and services. We may collect personal information about you including your name, position, contact details, licence or registration number, ABN, bank details and other information relevant to the capacity in which you are dealing with the company.
We generally collect this information to enable us to contact and deal with you and to fulfil any obligation or undertaking relevant to your relationship with the company.
